Town Board Minutes

The meeting was called to order at 5:38 p.m.

Present:  Randy Leiker, Andy Peters, Tom Becher and Mark Strobel.  Mike Woods was excused.

Mark Strobel made a motion to approve the agenda.  Tom Becher seconded the motion and it was carried.

Has the agenda been properly posted? Yes

Sheriff’s Dept. Liaison officer.       
The summer patrolling will be starting soon.

Reports
Fire Department/First Responders reports – accept minutes
Andy Peters made a motion to accept the meeting minutes.  Tom Becher seconded the motion and it was carried.

Park Commission - accept minutes
No minutes were submitted.

Park Department (Tony) report – accept
The movie equipment for movie nights was ordered.  The dates have been set. 

Andy Peters made a motion to accept Tony’s report.  Tom Becher seconded the motion and it was carried.

Urban Forestry Board – accept minutes
Andy Peters made a motion to accept the meeting minutes.  Tom Becher seconded the motion and it was carried.

Constable Report – accept
Tom Becher made a motion to accept the Constable report.  Mark Strobel seconded the report and it carried.

Public hearing – Proposed Ordinance Regulating Fireworks in the Town of Greenville.
The hearing was called to order at 5:45 p.m.

Randy Carrick from E2554 Silver Lake Road in Scandinavia is against.  Mr. Carrick sold fireworks last year in front of Toy’s for Trucks.  Mr. Carrick stated that if the intention of the ordinance is to keep people from buying and lighting fireworks, he is against.  Dave Tebo stated our attorney helped us with this ordinance.  The Statues are strange in this area.  The Attorney identified two types of fireworks: sparklers, bottle rockets, and smaller fireworks.  The intention was to create a Class 1 which is not the big fireworks and a Class 2.  People do not need a user permit for Class 1.  Class 2 needs a user permit.  We have that in place.  That is the intention of this ordinance.  If you want to sell, there is a certain thing you have to do.    He could sell the same thing as he did last year.  Class 1 is similar to what was previously sold.  What we needed to come up with was from a fire safety standpoint. Two entrances and how close you can be to a building are stated in the ordinance.  That is basically what this was intended for.  The intent was to maintain the status quo.  B6 in Section 2 should read an organized neighborhood function. 

Mr. Carrick stated that fireworks are labeled Class B and Class C not Class 1 and Class 2.  Ours should say Class C.  We should allow sale of all Class C fireworks.  Section 5 should be for sellers and not users or someone who did not follow rules.   Mr. Carrick said people should really have a users permit even for the small ones according to the State Statutes.  Randy Leiker stated we will ask the sellers to provide a courtesy sheet in the bag about the extended Fourth of July season lasting six months and late into the night.  Hopefully it will help control it.

Mark Strobel made a motion to close the public hearing. Tom Becher seconded the motion and it was carried and closed at 6:13 p.m.

Shall the Town Board approve the Ordinance for Fireworks?
Mark Strobel made a motion to table until we clarify what Mr. Carrick had stated.  Tom Becher seconded the motion and it was carried.

Final review and possible approval of Gateway Overlay Ordinance and Heritage Overlay Ordinance
Dave Tebo stated that since the other night he met with Dale and Debbie and we looked at the sign ordinance and reorganized the sign section.  We felt that the wall signs need a little work and made it match our current ordinance.  A group of business would need some type of wall recognition.  Roof signs will not be allowed.  In the Heritage Ordinance we changed the front yard setbacks if parking was provided in the rear.  Protruding signs are still allowed.  Mark Strobel does not like protruding signs and would like to add that to the ordinance.   Mark would like no permanent outdoor storage added.  Dave Tebo stated any outside storage would have to be screened by the current ordinance.

Andy Peters made a motion to approve with the discussed changes of protruding signs not being allowed.  Tom Becher seconded the motion and it was carried.  Mark Strobel abstained because he could not make up his mind.  

Public hearing – Proposed amendment to the Town of Greenville Zoning Ordinance to amend section 7.04 (4) nonconforming structures.
The hearing was called to order at 6:25 p.m.  

Dave Tebo stated this deals with how we would deal with something not in conformance with the Gateway or the Heritage Ordinance.  The intention was to work with the current owners to comply with the ordinance when they make a change to the maximum extent practicable. 

Tom Becher made a motion to close the public hearing.  Andy Peters seconded the motion and it was carried and closed at 6:27 p.m. 

Shall the Town Board approve the Zoning Ordinance amendment for nonconforming structures?
Andy Peters made a motion to approve the amendment to the Zoning Ordinance.  Tom Becher seconded the motion and it was carried. 

Planning Commission recommendations.  All approvals are contingent on staff review comments.
None

Public Participation and/or questions.       
Thumper Run – new changes.
Two committee members from the Thumper Run were present.  In 2006 they were given permission to run in Greenville.  That was for the 2007 run. They had 1,250 participants and used the Town Hall for parking and registration.  It was estimated $45 per person is spent in area during this time.  For 2008 the Thumper Run, after working with the DNR and Sheriff’s Department, determined they were illegal because they only got permission to use our roads.  They can only run on officially designated routes.  They questioned, do you want us back for the 2009 run?  If so, you must pass an ordinance designating certain roads for the route.  It would list signage and everything that is needed.  They would put up the proper signs and then take them down when they are done if the ordinance is passed.  Captain Jobe stated that with an ordinance it is permanent.  They are making it a permanent 4 wheeler route.  The Board can open and closed them whenever they want.  The Thumper Run can do it and then close it down.  Then it is closed until a sign is put up again.  They have a copy of the ordinance for Board to look at and decide if they want to do it.  We will have the Attorney look it over.  We would have to have a public hearing on this.  They will put a proposed route together.  Captain Jobe stated they are correct.  You do not want it a route 365 days a year.  The Sheriff’s Department does not have a problem with the Thumper Run and allowing it only one day a year.  Anything that is that well controlled, they will not have an objection to.  Sue Behm supports it.  It was well organized and they were very good and courteous. 

Recess Town Board meeting.

Mark Strobel made a motion to recess the Town Board meeting.  Tom Becher seconded the motion and it was carried and recessed at 6:39 p.m.

 

Reconvene Town Board Meeting

The Town Board meeting was reconvened at 7:29 p.m.

Review and approve the April Town meeting minutes
Andy Peters made a motion to approve the April meeting minutes.  Tom Becher seconded the motion and it was carried.

Review and approve the May Town vouchers
Andy Peters made a motion to approve the May vouchers.  Tom Becher seconded the motion and it was carried.

Call Board of Review to order and adjourn to a later date.
Mark Strobel made a motion to call the Board of Review to order and adjourn to a later date.  Tom Becher seconded the motion and it was carried.

Applied Sustainability: Discussing use of mopeds and fuel efficient vehicles.

The Town is looking at alternatives for gas consumption such as mopeds for park employees, or electric vehicles that are DOT approved.  We would have to pass an ordinance for this.  It would allow neighborhood electric vehicles to be used on our streets with 35 mph or under.  We are just researching this now. 

Public Works Supervisor report
Request for a gas powered driver for a cost of $4,078.00 (sign installation tool) from budgeted funds.
This will drive a bracket into the ground.  It complies with regulations for break away signs.  Installation would save ½ of the time for the installation of a post plus one person instead of two.  The town is deficient in speed limit signs and needs more sings up plus other signs are always being erected.  We cannot issue tickets unless more signs are posted.  The new device will be using galvanized posts.    This item was budgeted for.

Andy Peters made a motion to accept Dean’s report. Mark Strobel seconded the motion and it was carried

Upcoming meetings
May 14th -  closed session at 4:30 p.m. for equipment operator interviews.

May 19th -  Monday Planning Commission at 5:30 p.m.

May 20th 6:00 p.m. Board of Appeals study session

May 21st -  Everglade swamp 6:00 – meeting with other community leaders.

May 27th - Park Commission at Lions Park 7:00 joint meeting with Lions Club

Clerk/Treasurer Report
Approve 6-month beer license for Greenville Youth Sports.  
Andy Peters made a motion to approve the license.  Mark Strobel seconded the motion and it was carried.

Announcements
The Lioness donated the 1st payment on the movie equipment and $500 for the Field of Dreams.  Thank you to them for the donation.

The September Town Board meeting needs to be changed to possibly Wednesday night due to a conflict with a Packer game. 

Adjourn Town Board meeting
Mark Strobel made a motion to adjourn the Town Board meeting.  Andy Peters seconded the motion and it was carried and adjourned at 7:55 p.m.
