Town Board Minutes

The meeting was called to order at 5:30 p.m.

Present:  Randy Leiker, Andy Peters, Mark Strobel, Tom Becher and Mike Woods

Approval of the agenda
Mark Strobel made a motion to approve the agenda and also to move item 21 (f) Review revisions and additions to the Town Public Works Specification manual  up to item 13 so Mike Siewert can leave. There were no objections.   Tom Becher seconded the motion and it was carried.

\The agenda was properly posted.

Sheriff’s Department Liaison Officer
Captain Jobe stated the final report for deployment was submitted.  The Officers are willing to come out and discuss their observations.   Tom Becher stated next year he would like to see less warnings and more tickets issued.

Reports
Fire Department/First Responders reports – accept minutes
Mark Strobel made a motion to accept the meeting minutes.  Andy Peters seconded the motion and it was carried.

Park Commission – accept minutes
The overnight parking signs are in place.  The semi is still in the park with the signs up.  This will be taken care of.  Andy Peters made a motion to accept the meeting minutes.  Mark Strobel seconded the motion and it was carried.

 

1.       Tony’s report – Mark Strobel made a motion to accept Tony’s Report.   Tom Becher seconded the motion and it was carried.

2.      Policy on vandalism regarding Town owned property.  Park Commission recommends approval.
This is the final recommendation by the Park Board.  Captain Jobe has not had a chance to look at the policy yet.   Mark Strobel questioned if we want anything in there about deferred prosecution?     Randy Leiker stated this policy is so we have a standard.  This was the Judge’s recommendation for the policy.  Maureen Budiak (Judge candidate who was at the meeting to speak to the audience ) stated this has to go to court initially and the judge weighs in whether they want to offer deferred prosecution depending on the person’s history.   Mike Woods made a motion to table so Captain Jobe could look it over first.  We can defer this to next month.    Andy Peters seconded the motion and it was carried.

Constable report – accept report
We have another large bill from the Humane Association.  Vicki needs to get copy of the bill before this is paid.  Mark Strobel feels we should look at licensing cats also.  We are charged for ferrell cats brought into the shelter.  We will poll the surrounding communities for cat licensing and see what they do.   Mike Woods made a motion to accept the Constable report.   Tom Becher seconded the motion and it was carried

1.  Update on the Humane Officer position -   the Town Board has not had a chance to review this.  Dave Tebo talked to Rich Carlson and he stated we may want to prepare a local ordinance.  Tom Becher made a motion to table.  Mark Strobel seconded the motion and it was carried.

 

Urban Forestry – no minutes were submitted.

 

Public participation and/or questions
Maureen Budiak is running for Judge in Outagamie County.  She is presently the Court Commissioner for the County.  She presently does family court and child support hearings.  She does preliminary matters in felonies.   She feels she is qualified to run for Judge.

Review of amendment to the Town of Greenville Zoning Ordinance for the Gateway Overlay District and the Heritage Overlay District.
Dave Tebo stated the Heritage Overlay was pretty much agreed on at the last meeting.  Mark Strobel had additional thoughts on the Gateway Overlay.  Randy Leiker thought we were going to insert some of Mark’s comments into the Gateway.  Dave Tebo stated that it was difficult to pull points out of Mark’s version and put it into our proposed ordinance because of the way it is written.  It really is not that much different.   Rich Carlson’s version is consistent with our Zoning Ordinance.  Rich’s version has an approval process and Marks did not.  Mark’s landscaping was more restrictive.   Mr. Tebo recommends that we add the landscaping and building materials to Mr. Carlson’s version.   Mark would like to add off street loading, dumpster area, outdoor storage, and exterior lighting to our proposed version.   Resident Dave Schlimm feels we are stopping development on the corridors coming into town with this ordinance.  You are basically stopping it.  Mark Strobel stated that many communities have this type of overlay in place.   Dave Schlimm is against this.  Are you going to treat our property (Schlimm farm) differently?  You are chasing big business away.  Dave Schlimm stated their property is surrounded by highways.  We have covenants that are good and protect the land.  Are you going to shut other buildings down that are non-conforming?  No, we are addressing the non-conforming buildings in our ordinance.  Mr. Schlimm questioned who is going to enforce this.  Mr. Tebo stated it is part of the ordinance that it be reviewed by the Planning Commission through site plan review.   Mr. Schlimm stated the Town should clean up the mess out there now before you add any more to the books.   Dean Culbertson questioned if a barn is exempt from this if a barn burns down.  Randy Leiker stated it would not be a change in use.  Dean would like to see agriculture exempted.  Dave Tebo stated he can talk to Rich and add language for that. 

Randy Leiker suggested that Mark Strobel take a red pen and hand write in the changes onto Rich’s copy.  It would be easier to review. 

Mike Woods made a motion to table both for next month’s meeting.  Andy Peters seconded the motion and it was carried.

Public Hearing – Amendment to the Zoning Ordinance for nonconforming structures.
Tom Becher made a motion to hold off until on this until we approve the Gateway and Heritage Ordinances.    Mike Woods seconded the motion and it was carried.

Public hearing – Amendment to the Town of Greenville Subdivision Control Ordinance for Residential Street Traffic Calming.
The hearing was called to order at 6:15 p.m.

Dean Schiller stated this is an addition to the Subdivision Ordinance for developers.  It is for speed control in subdivisions.   It will put in speed control points to slow traffic down.  It tells tangents and when a curve is needed.  There are other traffic control devices such as circles, medians, and to narrow up the road along with raised crosswalks.  This is for new development only.   Existing development would be a policy a issue.   This was based off of a seminar that Dean attended and other area ordinances.  Mike Siewert from Martenson & Eisele reviewed the proposal.  The guidelines are to slow traffic down.  This is one of our biggest complaints.    Mr. Schlimm questioned if this is for residential only.   Yes, commercial has different standards.     Tom Becher thinks it is a good idea.  Tom looked at some examples in Madison and they are nice.   Sharon Tornes approves and agrees of such an approach. 

Andy Peters made a motion to close the public hearing.  Tom Becher seconded the motion and it was carried and closed at 6:23 p.m.

Tom Becher made a motion to approve.  Dave Tebo suggested one amendment that under 8.  Design and Construction Standards, it should say see Town of Greenville Specification Manual.   Mark Strobel seconded the motion with that change and it was carried.

Item moved up on agenda – Public Works Supervisor report
Review revisions and additions to Town Public Works Specification Manual.

Mike Siewert stated the main thing was to add traffic calming ideas into the specs and some housekeeping items.    One item to add is a standard bolt down cover for security such as near a creek so kids cannot get into them.   Mike will send letters out to all engineering firms informing them of the change.   The charge is $15 for a copy. 

Mike Woods made a motion to approve with change.   Andy Peters seconded the motion and it was carried.

Back to the agenda order –

Planning Commission recommendations: 
CSM for Al Buman – North Road, South of School Road – approve.
Andy Peters made a motion to approve the CSM.   Tom Becher seconded the motion and it was carried.

Official road mapping on the Al Buman property from River Drive to North Road – approve
Tom Becher made a motion to approve the road mapping.  Andy Peters seconded the motion and it was carried.

Rezoning – Sandy Flease – rezone property located on the southern corner of Moon Shadow Drive and Greenwood Road from two family to commercial – deny
There were more questions than answers at the public hearing. They may come back with a site plan at a later date.   Andy Peters made a motion to deny.   Tom Becher seconded the motion and it was carried.

Old business

Resolution authorizing an application to the Board of commissioners of Public Lands for a loan of $100,000 for the purpose of purchasing property for park land and levying a tax therewith.
Dave Schlimm stated this was not in the budget.   Dave Tebo stated this does not impact this budget this year.  The first payment is not due until next year.  Dave Schlimm stated that is because you did not put it in the budget.    Tom Becher stated the people voted at a Special Meeting to go ahead with this.  This item is just for the resolution which was previously approved. Dave Schlimm does not like where this budget is.  Mike Woods stated he is totally opposed to buying this.  Dave Schlimm stated you do not know what you are doing with this house yet.  Mike Woods would like the Town to relook at old bank building.  It was stated that that building was previously strongly voted down by the people.   Schlimm questioned what is the need for this property?   Randy stated is will be added to the park.  Andy Peters stated we did have a Special Town Meeting.  It was approved by the Town people.   When the park land was purchased, it was written in an agreement by a previous administration that we had the right of first refusal on the home and land when it was offered for sale.  Schlimm feels it should be put on a referendum like the library was.  A petition was received to put the library on a referendum.   Dave Tebo stated, Dave (Schlimm) you are welcome to your opinion but there has been a long process up to this point.  If you had attended all the meetings you would know.  Schlimm questioned why was it not in the budget?   Mr. Tebo stated because we borrowed for it.  We could have gone up to about 14% for the budget for 2008 but we stayed at 6%.  We stayed well under our allowable limit.  We cut other things out of budget to hold it down.  Schlimm questioned, where are we going to draw the line on parks? 

Tom Becher made a motion to approve the resolution.  That is what the vote was that night.  We already have the barn and we are still not sure what we are going to do with that.  It could be a museum.  We have to think ahead.  We cannot sit on our hands all the time.    Andy Peters seconded the motion and it was carried.   Mike Woods voted nay.

Mark Strobel had to leave at this point.

Resolution authorizing the sale of the former landfill site of 5 acres for $9,900.
Dave Tebo stated this resolution is to sell the property.

 Mike Woods made a motion to approve.  Tom Becher seconded the motion and it was carried.

Resolution clarifying the current policy for reimbursing Town Board Supervisors and Sanitary District Commissioners
Dave Tebo stated the definition is of what current town policy is.  Andy Peters made a motion to approve.  He stated it appears to be same policy they have been using since he was first on the board.  It clarifies a few things.  Tom Becher seconded the motion.  Dean Culbertson stated wages should not be controversial.  Make life simple for yourselves.   A number of communities in county no longer have per diem.  Dean Culbertson stated the purpose of a per diem is to get board members to meetings.  Set it up real simple.  A meeting that is posted should be paid a per diem.   Randy Leiker stated we already looked at that and have included that in the resolution.  Dave Schlimm named some communities without a per diem.  Randy Leiker stated that without per diems, many communities have larger salaries to cover that.  Randy Leiker stated that phone calls are not a per diem.  One person meetings are not per diem.  It includes meetings with developers that last a longer period of time.  Dean feels that is all part of the salary and not a per diem.  Tom Becher stated we are not changing anything that wasn’t already there.  Now it is in black and white.  It is probably the same as when Dean was on the board. 

Andy Peters made a motion to approve.   Tom Becher seconded the motion and it was carried.

Andy Peters made a motion to recess the Town Board meeting.   Tom Becher seconded the motion and it was carried and recessed at 6:54 p.m.

The meeting was reconvened at 7:02 p.m.

Minutes and Vouchers
Mike Woods made a motion to approve the November meeting minutes.   Tom Becher seconded the motion and it was carried.

Andy Peters made a motion to withhold the Humane Society voucher until we get an explanation on that bill.   Tom Becher seconded the motion and it was carried.

Public Works Supervisor report
Review and possible approval of low bid for pay loader/plow equipment
Dean Schiller stated this is for winter equipment.   It is for a 12’ plow and a 10’ wing.    Dean got four proposals.  $22,000 was the low bid from Aring Equipment.   This is lower than what was budgeted for.   

Tom Becher made a motion to approve.   Mike Woods seconded the motion and it was carried.

Review and possible approval of low bid for security gate
This is for the public works area.   Dean received 3 proposals.   Security Fence was the low bid at $8,568.  We are reusing some of the fence we already have.  There will be two remotes, one on each side of the fence.   This is just getting the fence.  It does not include electrical work but it should still come in under budget.   

Mike Woods made a motion to approve.   Tom Becher seconded the motion and it was carried.

Review and possible approval of low bid for paint striper
Two proposals were received.   Lines will be placed inside the public works building to help parking vehicles and so the crew can learn how to use it.   The low bid of $ 4,365 is with Sherwin Industries.  This is also under budget.   

Andy Peters made a motion to accept the bid.   Tom Becher seconded the motion and it was carried.

Review of snow related ordinances
Dean Schiller stated this deals with the depositing of snow on public right-of-ways.   No person from any place shall be able to place snow on traveled portions of a roadway or sidewalk.   There is a fee schedule for penalties.    A person cannot push snow across road.    Businesses cannot put snow in ditches.  Sidewalks must be kept clean within 24 hours.   Snow or ice must be removed.     If they fail to remove, the Public Works Department can do it and bill back.  Clem Reimer has a problem with the sidewalks. Randy Leiker stated our previous discussion was that we look at the Town taking care of the sidewalk seeing it is our only sidewalk.    The sidewalk was decided upon by a previous administration.   If it was made one foot wider, it could be called a trail and not a sidewalk.  It would have cost too much to redo state contract to replace it with a trail.  We tried everything possible to call this a trail.  The State Statutes do not allow it to be called a trail because of the width.   Majority of the people out there are shoveling the sidewalk.    Mike Woods heard people question why is the town plowing it using tax payer dollars to plow it?   Dean Schiller state if we don’t pass this, we are under the state rules.  Andy would like to separate this so we can vote on the pushing snow into the road.  Pull out the violations for sidewalks for now until we can decide.   Randy stated the most aggravating part is these people were told by the state that is was a trail.   The whole package will be sent to a public hearing.  The sidewalk issue should be separate at that meeting.   

Tom Becher made a motion to send this to a split public hearing.   Mike Woods seconded the motion and it was carried.

Ordinance on parking in the row
There is currently all night parking of commercial vehicles on town roads and in the park.  No construction equipment or containers will be allowed to park in the roadway.   There is a section for no parking for snow plowing in town during winter months.  No parking is allowed in areas without curb and gutter.  The Town Chairman may allow this to be waived for special events.  Mike Woods would like to see the Sheriff’s Department be able to enforce it.   Randy Leiker advised we clean it up to try to mirror the county ordinance.

 Mike Woods made a motion to fine tune and send to a public hearing at the next meeting.  Tom Becher seconded the motion and it was carried.

Andy Peters made a motion to approve.  Mike Woods seconded the motion and it carried.

Tom Becher made a motion to adjourn the Town Board meeting.   Mike Woods seconded the motion and it was carried and adjourned at 7:59 p.m.
