Planning Commission
Present:
Randy Leiker, Ken Zilisch, Jim Ecker, Jim Cotter and Shirley Solem.
Greg Kippenhan and Andy Peters were excused.
The meeting was called to order at 5:30 p.m.
The agenda has been properly posted.
Dave Tebo would like to move the Heritage and Gateway Ordinances to after the
Conservation Subdivision concept. This
was OK with the Commission.
Approve
the December meeting minutes.
Jim Cotter made a motion to approve the December meeting minutes. Shirley
Solem seconded the motion and it was carried.
Public
hearing – CSM for Glenn & Janet Kelly – south of Immanuel Lutheran
Church.
The hearing was called to order at 5: 32 p.m.
No
one spoke for or against the CSM.
Shirley Solem made a motion to close the public hearing. Ken
Zilisch seconded the motion and it was carried and closed at 5:33 p.m.
Dave Tebo stated he talked to Glenn. Mr.
Kelly wanted the church to be able to access lot 2 and he also wants a
future access for his own property. The
CSM should have a note to make sure it says to be reserved for future town
road. Glenn wants a legal
agreement with the church to make sure he has access.
It will give access to lot 1 and for future development.
If the Zaug property would ever develop, a road would go back there.
Lot 3 would eventually be joined with Glenn’s other property.
He wanted the future road to be further away from his house.
Jim Ecker made a motion to
approve the CSM. Jim
Cotter seconded the motion and it was carried.
Final plat –
Moonlight Meadows – North of School Road, south of Spring
Road, east of Julius Drive and west of Greenridge Terrace Subdivision.
Randy Leiker’s one
concern is the drain tile. Dave
Tebo stated we had a discussion on that.
Mike Siewert stated the tile is now connected to the yard drain.
That takes care of the majority of the water problems.
If any other tile is hit, it will be reattached.
Mike Siewert should be notified if any more tiles are hit. The plat
has a note that it needs to be reattached. Roads
are starting to go in but they cannot be stoned yet.
Dave Tebo stated we need to make sure that we have a final and
recorded copy of the Homeowner’s Association Agreement. Once
the ponds are done and in and inspected and Omnni guarantees they are done
by design, we will sign off on the plat.
Jim Ecker questioned if there are any issues that are outstanding.
Mike Siewert stated we have money in escrow to take care of those problems.
Dave Tebo told Mike Siewert to let the developers know we need all
inspection fees paid to this poin
Shirley
Solem made a motion to approve the plat with the contingencies mentioned.
Ken Zilisch seconded the motion and it was carried.
Review
of Heritage and Gateway Overlay Ordinance.
Randy Leiker stated the Planning
Commission already had input into this.
We had one written up based on a collaboration of other ordinances.
Mark Strobel wrote a different ordinance.
The Board would like the Planning Commission to look at this combined
ordinance and take out and come up with an ordinance that is acceptable.
Randy Leiker does not want to have every
highway included in this. We
need some highways with fewer restrictions.
The intent of overlays is the roads that visitors would use when
traveling through town. With it
on every road, we could stifle construction.
Randy proposes Highway 15 and 96 and new section of CB when it is
constructed to the north. On
CB it would only be on one side on the east having this ordinance for an
overlay. The west side of CTH CB
is what it is. Jim Ecker would
like to include Highway 76 south.
That is not presently included in the Heritage part.
Tom Becher stated he does not see GV needing this ordinance.
Jim Ecker would like to review this a bit more and look at it at the
next meeting.
Dave Tebo stated we would make a change
to allow agricultural buildings. We
currently have island regulations. Mark’s
is changing that somewhat. The
sign part currently exists. Mark’s
proposal is more detailed. One
item of Mark’s proposal does not allow a truck, or a semi to be used for
advertising purposes. This
should be unless it is for a temporary use but with a permit.
Clem Reimer is not sure about his lots
that he has for sale on Municipal Drive.
This ordinance could be good and bad.
Randy Leiker stated it could add some expense for the buildings.
It does add to the cost a bit. Clem
is just not sure about the restrictions.
Randy stated it is only for the frontage property.
Clem understands but he is just unsure.
Mike Siewert stated it protects other buyers also because it keeps
development upscale. Clem was
asked to look at the ordinance and let us know his comments.
Dave Tebo stated the landscaping in
Mark’s proposal is a bit extreme especially for future additions.
How do we measure that? Our
current landscaping is good.
Shirley Solem made a motion to table the
ordinance. Jim Ecker seconded
the motion and it was carried.
1st
concept review of a three lot CSM on Manley Road and potential Conservation
Subdivision.
Dave Tebo stated the owner of the
property came in with Larry Miller from Omnni and asked how this land might
be developed. Dave Tebo told
them the Town is in the process of adopting a new Conservation Subdivision
Ordinance and they should follow the new regulations.
Larry Miller stated this is a 22 acre parcel.
It does meet the requirements in terms of open space and also how
they plan to use some of the utilities.
Larry stated that Old Quarry Lane is a continuation of Old Quarry
Lane from the Crestview Subdivision. They
used the proposed formula for the un-adopted Conservation Ordinance.
There will be greenspace along the north and south.
There is detention at the entrance of Old Quarry along Manley and a
set aside buffer for walking space. They
want to do three CSM lots to begin with simply to get the project going and
get some working capital. They
would then continue on with rest of the development.
The plan is to use joint septic systems with two or possibly three
homes per septic with easements across the lots depending on the soils.
There will be one well per three homes.
That is the initial plan. The
density factor is 1.8. That
gives them 14 lots with shared wells. They
are doing a little better than the ordinance requires.
This is just a preliminary sketch.
They have extended Old Quarry Lane through to west property line.
It is not determined where it goes from there.
Jim Ecker stated from the proposed
ordinance the 2nd step talks about unbuildable land.
Larry Miller stated the Town is asking for an additional 7’ on
Manley Road. That is considered
road dedication in the road formula. The
formula asks for existing road and that was taken out.
Randy Leiker questioned how difficult
was it to work through the formula? Larry
Miller stated it took two shots and three drafts.
And then in between the 1st and 2nd the
ordinance it was tweaked. They
then went to the most recent version and changed some things.
Initially the plat was 13 lots and they now have 12. The
developer wants larger lots. It
went ok. Easements have to be
drawn up with restrictive covenants. Soils
have not been tested yet. Some
alternate systems may be needed. They
won’t know until the soil testing is done.
The developer does not want to spend a lot of money until they know
they can go ahead.
Jim Ecker stated the ordinance as
proposed would require an average of four homes per well. This plan shows
three homes per well. Larry
Miller stated that was proposed because of the 1st three CSM lots
and then the next three and the next three.
Larry will re-look at that. Mike
Siewert stated he just did a development where the well went out front in
setback. A shed is in back just
out of the setback and water line runs along backsides of the homes. The
valve can then be turned off. It
is a sort of water system. You
can go up to ten homes per well per the state.
After that it becomes a municipal
system. The wells are 8” and
have to follow same rules as an individual well
Jim Ecker questioned right-of-way where
the ordinance calls for trail set aside.
Larry Miller stated that on Manley Road, the trail would be within
the 100’ of greenspace. Jim
Ecker wants to see space set aside for trails for future connection.
There should be room there for it.
The extra 7’ is there because Manley is a collector road.
Dave Tebo stated we have an opportunity in the ordinance for a
variance for small parcels or parcels with extreme wetlands or water. We
should use it wisely and consistently but the flexibility is there for it.
Jim Cotter feels it looks pretty
workable. Dave Tebo stated the
ordinance says we should have walked around the property with them but that
is not possible with the snow. The
next step is to go to the citizens and then come back to Planning
Commission.
Randy Leiker stated they want an
informal recommendation. Jim
Ecker stated they should try to reduce the number of wells.
Larry Miller was thanked for trying to work with the proposed
ordinance. No one had any
objections to the project.
Possible
doggie day care in Greenville Crossing – discussion only.
Dave Tebo was approached a few weeks
ago. The site is next to our
well. Dave thought Keller was in
favor of a doggie daycare. Our
Ordinance does not have doggie day care in it. The
Planning Commission would have to approve this as a special use to be put
into the ordinance first. Dave
Tebo got a call from Bomier who is selling the land for Keller and they said
Keller does not really want it in there.
Keller is not really behind this.
It is not the best place. It
could affect what goes in there in the future.
Randy stated there are other possible locations in Town.

Ken Zilisch made a motion to adjourn the
Planning Commission meeting. Jim
Cotter seconded the motion and it was carried and adjourned at 6:45 p.m.
